Victim get to $25,000 in beating case

SANTA ANA (AP) – Two white men who attacked a Hispanic janitor outside an Orange County hamburger stand in 2007 must pay $50,000 to the victim.

Felony assault charges with hate crime allegations were originally filed against James Joseph Kelly III and Justin Louis Mullins, but they later pleaded guilty to misdemeanor assault for the brutal beating of Felipe Alvarado in the parking lot of a Garden Grove In-N-Out restaurant.

The California attorney general’s office then filed a civil case under the Ralph Civil Rights Act, which allows violent crime victims to pursue civil penalties.

The judgment signed in Santa Ana last week orders the 28-year-old Kelly of California City and 26-year-old Mullins of Garden Grove to each pay $25,000 to Alvarado.
